These Terms govern all use of the ATS Feeds website, catalog products, and API (collectively, the "Service"). The Service is operated by Sascha Klatt Software Development ("Company," "We," "Us"). By accessing or using the Service, You agree to be bound by these Terms.
1. Description of Service
1.1 — ATS Feeds provides a catalog of verified ATS job feed metadata — account slugs, feed URLs, and related fields — for supported applicant tracking systems, along with aggregate statistics and derived analysis (including products such as TechStackRadar) built from that catalog.
1.2 — Service availability. We use commercially reasonable efforts to keep the Service available but do not guarantee uninterrupted or error-free operation. No uptime SLA is offered unless separately agreed in writing.
1.3 — Aggregator role; no ownership of underlying data. ATS Feeds functions as an aggregator and discovery service for third-party feed metadata sourced from ATS platforms, job boards, and other upstream providers. We do not assert ownership of, or any copyright claim over, the underlying job postings or job data made available by those upstream providers. Our role is to catalog, validate, and provide access to feed locations and related metadata as a facilitator, not as a proprietor of the underlying data. You are solely responsible for ensuring Your use of any data obtained via a feed URL complies with the applicable terms of the original ATS platform, job board, or employer.
1.4 — We do not control the accuracy, completeness, legality, or continued availability of upstream feeds. Upstream providers may at any time remove, alter, restrict, or block access to their feeds without notice, in which case the affected catalog entries may become stale or unavailable. The Service is provided on this basis "as-is," and we disclaim responsibility for consequences arising from upstream changes or restrictions.
1.5 — Derived and aggregate data. Certain outputs of the Service (including TechStackRadar and any other aggregate statistics, trend, or classification fields) are generated by automated analysis of upstream data and may contain inaccuracies, omissions, or misclassifications. Aggregate statistics may be refreshed on a schedule and lag behind the live catalog. We make no warranty as to the accuracy of any derived or aggregate field, and You are solely responsible for independently validating any such value before relying on it for decisions with material consequences (e.g., compensation benchmarking, hiring, or market analysis).
2. Acceptable Use
2.1 — You may use the Service to integrate, analyze, or display feed and job information in compliance with applicable law and the terms imposed by each underlying ATS platform, job board, or employer.
2.2 — No reselling of raw catalog data. You may not resell, sublicense, redistribute, or otherwise make available the raw catalog (feed URLs, slugs, or underlying job data obtained through a feed) to third parties as a standalone data product. Using the catalog internally, or to power features within Your own product, is permitted under Your subscription; bulk redistribution of the raw catalog itself is not.
2.3 — No competing service. You may not use the Service to create, operate, or offer a commercially offered product whose primary business purpose is the aggregation, resale, syndication, or redistribution of ATS feed metadata or job posting data. This does not prohibit ordinary use of the catalog to power features within an end-user product (e.g., a job board, ATS, or matching platform).
2.4 — No reconstruction of discovery methods. You may not attempt to reverse engineer, reconstruct, or replicate Our undisclosed methods for discovering, validating, or cataloging feed URLs.
2.5 — Technical restrictions. You may not bypass, circumvent, or interfere with rate limits, authentication, or other access-control mechanisms of the Service, nor use automated means to access the Service outside the documented API surface and the limits assigned to Your account.
2.6 — You may not use the Service to harass employers, candidates, or any other party, or to introduce malware or disruptive code.
2.7 — Violation of this Section is grounds for immediate suspension or termination of access without notice or refund.
3. Account & Credential Security
3.1 — You are solely responsible for safeguarding Your API key(s) and access credentials. You must not share, publish, or commit credentials to source control, and must promptly notify Us of any suspected unauthorized use. We are not liable for consumption of credits or other consequences resulting from compromised credentials.
4. Billing
4.1 — The Service is offered through one or more of: a subscription via RapidAPI, a one-time export, or a separately negotiated custom agreement. Billing terms, renewal, and refund policy for each product are governed by the terms of that specific product offering; where those terms conflict with this Section, the product-specific terms control.
4.2 — Refunds, where offered, are issued at Our discretion and are not available for credits or access affected by user-side errors (e.g., misconfigured integrations, excessive duplicate requests).
5. Disclaimers
5.1 — The Service, including all catalog data, feed metadata, and derived/aggregate statistics, is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
5.2 — We do not guarantee completeness of the catalog, continued availability of any feed, or accuracy of employer participation, job counts, or derived statistics. Feed availability and job counts change over time and may not reflect real-time upstream state.
5.3 — You access and use the Service, and any data obtained through it, at Your own discretion and risk.
6. Limitation of Liability
6.1 — To the maximum extent permitted by applicable law, We shall not be liable for any indirect, incidental, consequential, or lost-profit damages arising from use of, or inability to use, the Service, including damages resulting from upstream feed changes, removals, or inaccuracies, or from Your use of derived/aggregate data in any decision-making process.
6.2 — Nothing in these Terms limits liability that cannot lawfully be excluded under applicable law.
7. Intellectual Property
7.1 — As between the parties, We own all intellectual property rights in the Service itself, including the catalog structure, the discovery and validation pipeline, normalization processes, and all derivative datasets and aggregate statistics We produce (including TechStackRadar). These Terms grant You no rights beyond the access and use rights expressly set out herein.
7.2 — Ownership of the underlying source data — job postings, feed content, and related information — remains with the original ATS platforms, job boards, and posting organizations from which it was sourced, as described in the Description of Service section above.
8. Changes to These Terms
8.1 — We may modify these Terms at any time. Material changes (affecting fees, acceptable use, intellectual property, or Your data) will be notified by email to the address on Your account; non-material changes (corrections, clarifications) take effect upon posting. Continued use after a change constitutes acceptance.
9. Refusal, Suspension & Termination
9.1 — We reserve the right to refuse, suspend, or terminate access to the Service at Our sole discretion, including where We have reasonable grounds to believe these Terms have been violated.
10. Governing Law and Jurisdiction
10.1 — These Terms are governed by the laws of Germany. Disputes shall be subject to the exclusive jurisdiction of the courts of Germany.
11. Miscellaneous
11.1 — Entire Agreement. These Terms, together with Our Privacy Policy and any product-specific terms agreed in writing, constitute the entire agreement between You and Us regarding the Service.
11.2 — Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remaining provisions remain in effect.
11.3 — No waiver. Our failure to enforce any provision is not a waiver of that or any other provision.
